Terms of use

The agreement between you and AIM Dev Ltd when you book through this service or run an event on it.

What this service is
Software that lets an organiser publish an event page, take bookings and check guests in at the door. It is run by AIM Dev Ltd, Auckland, New Zealand, and is in beta.
Who you are buying from
Your ticket is sold by the organiser named on the event page, not by us. The organiser is responsible for the event: what it is, whether it happens, and what happens there. We provide the software and are not a party to that sale.
Paying for a ticket
Prices are in New Zealand dollars and include GST where the organiser charges it. A bank transfer goes from you straight to the organiser's account; we never hold ticket money. A card payment is taken by Stripe into the organiser's own Stripe account and confirms your place at once. A place paid by transfer is held for a limited time and is confirmed when the organiser confirms the money arrived. Use the reference shown on your booking. A place that is not paid in time is released.
If you cannot come, and refunds
Each event page says, before you book, whether a paid ticket is refunded when you give up your place. You can pass a ticket to a friend from your booking page. Refunds are paid by the organiser. We cannot refund money we never held, but the service helps: it tells the organiser a refund is due and passes on the account you want it sent to.
If an event is cancelled or changed
The organiser must tell the guests and refund paid tickets for a cancelled event. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
If you organise events
You describe your event accurately, hold it as described, and hold whatever licences and permissions it needs. You are responsible for the event, for your guests' safety, for refunds, and for your own tax and GST. You use guests' details only to run that event, and do not send them marketing they did not ask for.
Our fee
Free events cost nothing. For a paid ticket our fee is 3% + $0.30, GST included, added to the guest's total unless you choose to absorb it. For tickets paid by bank transfer the fee reaches your account with the ticket money, so we send you a statement after the end of each month, payable by bank transfer. For tickets paid by card, Stripe takes our fee out of the payment as it is made, and nothing is added to your statement. A month with less than $10 in fees is not charged. If we change the fee we will tell organisers at least 30 days ahead, and it will not apply to tickets already sold. Our fee is kept when a ticket is refunded, and a booking fee paid by the guest is not refunded. A statement left unpaid for 14 days pauses that organiser's bank-transfer and PayPal bookings until it is paid.
What is not allowed
Events that are illegal or that you do not intend to hold, misleading descriptions, taking bookings to collect people's details, spam, and attempts to break, overload or get around the service. We may remove an event or close an account that breaks these terms, and tell its guests.
The service as it is
We work to keep the service running and your data safe, but we do not promise it will never be interrupted. Organisers should download the guest list before an event; the door screen also works without a signal once opened.
Our liability
To the extent the law allows, we are not liable for the event itself, for what an organiser or a guest does, or for indirect loss. Our total liability to an organiser is limited to the fees that organiser paid us in the previous twelve months. An organiser who uses the service in trade agrees that the Consumer Guarantees Act 1993 does not apply to the service we provide to them. Nothing here limits the rights of a guest as a consumer.
Your details
How we handle personal information is set out in the Privacy policy.
Changes, and the law that applies
If these terms change we will publish the new version here with its date; using the service after that date means you accept it. New Zealand law applies and New Zealand courts decide any dispute.
